Terms of Use

These conditions govern access to Polk County Criminal History. Visiting a page, reading its content, or using a search tool means that you accept them. Do not continue to use the website if you disagree with any part.

NO FCRA USE. This privately operated website is not affiliated with Polk County, Nebraska, or any government body. Neither it nor its advertising partners provides a service for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). It is a public-record reference resource, not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site with no government ties. We neither host official criminal records nor retrieve records, perform official checks, or submit filings for a visitor.

Its purpose is to identify the custodians of Polk County criminal records, including the sheriff, local courts, Nebraska State Patrol Criminal Identification Division, and Nebraska Sex Offender Registry, and to provide links that may aid lawful personal research.

2. Rules for Using This Site

By using the site, you agree not to:

  • Break any federal, state, or local law while using this site
  • Use information you find here to stalk, harass, or threaten anyone
  • Base hiring, housing, lending, or insurance decisions on content from this site
  • Try to break into our systems or gain access you are not supposed to have
  • Run bots, scrapers, or automated tools against our pages
  • Do anything that slows the site down or blocks other people from using it

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked tool must not be used to stalk, harass, intimidate, threaten, or unlawfully discriminate against anyone. Nebraska Sex Offender Registry data is supplied for community awareness. Retaliation, threats, and vandalism aimed at a registrant or family can lead to arrest and prosecution.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and do not create consumer, credit, or official background reports. Data from the website or a linked tool may not be used to:

  • Decide whether to hire or fire someone
  • Screen potential renters or housing applicants
  • Judge creditworthiness or set insurance premiums
  • Determine who qualifies for licenses, permits, or government programs
  • Do anything else that falls under FCRA rules

A check for a regulated purpose must be obtained through a properly authorized Nebraska State Patrol channel or an FCRA-compliant provider.

5. No Legal Advice

Website content is not legal advice. General information about Polk County records cannot determine how a charge, conviction, warrant, set-aside, or redaction law applies to one person. Consult a Nebraska attorney for legal advice.

6. No Warranties

All services and content are offered "as is." We make no promise that:

  • Information will always be current, complete, or accurate
  • Access will be continuous or free from interruption
  • Every page will lack errors, defects, or security weaknesses
  • A search partner will return complete or correct results

Criminal records can change as cases are filed, dismissed, sealed, corrected, or set aside. Gaps are unavoidable, and no website statement should be treated as an official statement by a court, sheriff, or agency. Nebraska Public Records Statutes §§84-712 through 84-712.09 also permit lawful limits on disclosure, and §29-3523 restricts dissemination of specified criminal-history information.

7. Third-Party Services and Links

Links may lead to sheriff, court, state-agency, legal-resource, and outside-search websites that we do not operate. We are not responsible for an external service's content, availability, price, or data practices. Read its terms before use.

8. Intellectual Property

Text, graphics, logos, and code on Polk County Criminal History belong to us or our content partners. They may not be copied, changed, distributed, or used to make derivative work without prior written permission.

9. Limits on Our Liability

To the maximum extent allowed by law, we are not responsible for loss or damage arising from use of the website, its information, or a linked service.

10. Indemnification

You agree to defend and hold us harmless against a claim or demand caused by your use of the website or violation of these conditions, including related legal costs and fees.

11. Governing Law

Nebraska law governs these terms. Any dispute tied to use of the website must be brought in a court located in Nebraska.

12. Changes to These Terms

We may revise these conditions. A revision becomes effective when the new text is posted on this page.

13. Cutting Off Access

Access may be restricted or ended at any time and without advance notice.

14. Severability

If one provision is held invalid or unenforceable, all remaining provisions continue in force. The affected language will be limited only as much as needed to make it enforceable.

15. Questions

Questions about these conditions may be submitted through the Contact page.
